Terms & Conditions

 

 

Please note that these are the General Booking Terms and Conditions imposed by "Tasukete Pty Ltd". These policies should be considered as an addendum to the Terms & Conditions provided by service providers such as: tour operators, hotels, restaurants etc.

Summary

 

References to “we”, “us” and/or “our” in these Booking and Consultancy Services Terms and Conditions mean “Tasukete Pty Ltd”.

      

  We are a travel agent. We arrange travel services and sell a Travel Product on behalf of third party Travel Suppliers (Suppliers), including tour operators, hotels, car rentals, restaurants etc. We may charge a service fee for providing this service subject to the suppliers' T&Cs.

Once you have booked a Travel Product on your behalf, your contract will be formed with the Supplier of such services.    

    

 Your rights to modify or cancel your Trip Booking and the cost thereof will be governed by the Supplier's terms and conditions. The Supplier's terms and conditions may be non-refundable or may include change and cancellation fees. It is important that you understand this when you enter into a contract with us. These fees are in addition to the change and cancellation fees we charge, which are set out in the Professional Services Fee Schedule.

Agency

​

We provide you with booking and consultancy services that allow you to purchase travel products from a supplier. We act as agents for the Supplier.

​

By purchasing our booking and consultancy services, you agree that you have read and understood our terms & conditions and the terms & conditions of the Suppliers.    

 

 

Rates and commissions

 

We charge a fee for providing booking and consultancy services. The fee is non-refundable, even if the Travel Product is not used.

 

All fees are described in the Professional Services Fee Schedule.

 

We may receive commissions, discounts, or financial incentives from Suppliers in connection with your booking. Any commission, compensation, discount and/or financial incentive received by us from Suppliers in connection with your booking is non-refundable in the event of cancellation.

Agency Responsibilities and Limitations of Liability

​

We are responsible to you for providing booking and consultancy services in accordance with these terms and conditions.

​

Our travel booking and consultancy services come with guarantees under the Australian Consumer Law which cannot be excluded. Such warranties include that the services

 

will be provided with due care and competence;

 

will be reasonably fit for the specified purpose;

​

can reasonably be expected to achieve the desired result; AND

 

will be provided within a reasonable time.

    

If we do not meet any of your expectations in paragraph 11, you have rights under Australian Consumer Law.

​

Subject to Australian Consumer Law, we are not responsible for any technical errors, data corruption, unauthorized access to your personal data, inaccuracies in information provided by you or any third party, or failure to complete any bookings where such error is due to circumstances outside from our control.

​

Without prejudice to the application of any consumer guarantees which may be implied in the provision of the booking and consultancy services to you, we are not otherwise liable to you or anyone else for any loss or damage suffered directly or indirectly in connection with :    

   

the delivery or non-delivery of the Tourist Product; OR

​

any act or omission of Suppliers or other third parties.

​

Other than any rights you have under the Trade Practices Act which cannot be legally excluded, we will not be liable for any inconvenience, delay, loss, death, injury or damage to you or your property or otherwise caused directly or indirectly by the acts, omissions or defaults, whether negligent or not, of third party suppliers, force majeure or any other event beyond our control.

Nothing in these terms and conditions is intended to exclude or limit the application of consumer guarantees under the Consumer Protection Act

Supplier Responsibilities

​

Once you purchase the Booking and Consultation Services from us, the Supplier will provide you with the Travel Product on the terms and conditions agreed between you and the Supplier. You must obtain and read the Supplier's terms and conditions before purchasing the Booking and Consultancy Services from us.

 

The Supplier is liable to you for breach of obligations in the provision of the Travel Product.    

    

As an agent of the Provider, we have no control over or responsibility for the services provided by the Providers. We cannot guarantee the performance of the Supplier and have no liability whatsoever in respect of the provision of Travel Products, including any liability in contract, tort or otherwise, for any injury, damage, loss, delay, additional expense or inconvenience caused directly or indirectly by any supplier of travel services or products by the Suppliers. All bookings with us are subject to the terms and conditions and limitations of liability imposed by the Supplier.

Booking terms

 

The Travel Products offered are subject to availability and may be withdrawn without notice by the Supplier. Travel Products may also change at any time in accordance with the Suppliers' terms and conditions.

 

At the time of booking it is necessary to correctly provide the details of each traveler. We accept no responsibility for any loss or damage resulting from incorrect entry of traveler details.

Travel Products obtained through the Booking and Advisory Services are not guaranteed until payment is complete and documents are processed.    

    

It is your responsibility to contact the Supplier before departure to ensure there are no changes to the scheduled departure time.

 

Most Suppliers only offer electronic booking confirmation, also known as "e-ticketing". We cannot be held responsible if your e-ticket does not arrive due to an incorrect email address or junk mail settings. You must notify us immediately if you change your email address or contact telephone number after making a booking. It is your responsibility to notify us if you have not received confirmation of your e-ticket.    

    

Some reservations require a deposit of up to 20% to be paid at the time of booking. We will let you know the surcharge before final payment for your booking. This deposit is non-refundable and is in addition to the deposit required by the Supplier. The balance of the booking fee is due as requested by the Supplier.

Booking requests must be submitted at least 3 hours before the requested service to ensure adequate time for processing the request. Requests made at shorter notice may not be processed in time due to the high volume of requests and therefore cannot be guaranteed.

 

We handle all our bookings from 10am to 10pm Melbourne time. Booking requests received outside this time frame will be processed during the next available shift.    

    

When making a booking you must advise your consultant of any medical, dietary or mobility conditions you may have.

You must notify us at the time of booking if you are pregnant.

​

 

Payment terms

    

All prices are expressed in Australian dollars or euros, unless otherwise specified, in foreign currency and will be calculated at the exchange rate of the day.

​

All prices are inclusive of Goods and Services Tax (GST) or other value added taxes, where applicable.

​

Payments processed in a foreign currency (currency other than the original cardholder's issuing country) may be subject to a currency conversion fee. Please refer to your financial institution for applicable fees.

 

We sell travel products in two different ways:

​

as a merchant, where we take payment directly from you upon confirmation of your booking; OR

​

as retail, where the Travel Product will be paid to the Supplier directly at the time of booking, or payable to the Supplier by the date of travel, or the date requested under the Supplier's terms and conditions.    

    

Travel Products purchased in accordance with the “retail” method will not be bound by these terms and conditions and you will be responsible for pursuing any cancellation, rescheduling, refund or chargeback claims directly with the merchant.

As a trader we are governed by the terms and conditions of the trading facility provider.

​

Some Suppliers and low-cost operators may also charge a credit or debit card fee. You will be informed of these charges prior to purchase

 

All charges, including credit card fees, may be denominated in another currency, for which we will provide an estimate in Australian dollars or euros.

    

If you cancel the Travel Product, your right to a refund or credit is subject to the Supplier's terms and conditions.

If the Supplier is required to provide you with a refund or credit for the Travel Product, we will work with the Supplier to arrange such refund. Where you are entitled to a refund, we will not be able to provide you with such a refund until we receive it from the Supplier. Please note that most vendors take 60-90 days to process any refund.

 

Any refund or credit will be subject to these terms and conditions and will not include the booking and service advisory fee, credit card fees or any commissions received. You may also be charged cancellation fees by the Supplier.

 

Where refunds are permitted for unused services, the Supplier may charge a service fee on the value of the refund.    

    

If you have a booking for a Travel Product (including transport and accommodation) but fail to check-in or otherwise avail of such Travel Product, you will not be entitled to any refund from us.

 

If you change or cancel your Travel Product, we reserve the right to charge cancellation and change fees in accordance with the Professional Services Fee Schedule.

 

The Supplier may charge cancellation and amendment fees in accordance with the terms and conditions agreed between you and the Supplier. These will be in addition to the fees charged by us. We are not responsible for any cancellation penalties or refund refusals by the Supplier.

 

Many Suppliers treat name changes and route and/or itinerary alterations as a full cancellation and may incur full cancellation charges.

 

We will not charge a cancellation or amendment fee if you cancel or amend your booking due to a breach by us of our obligations to you or through our fault.

Cancellations and changes for hotel reservations only

​

Please see the hotel's reservation cancellation policy for any applicable penalties.

​

 

Force Majeure

 

We will not be liable for any failure or delay in performance of our obligations in booking the Travel Product due to events outside our control.

 

If a force majeure event occurs (e.g. natural disaster, terrorist attack, public demonstrations, strikes, etc.) that affects your booking, your right to a refund, credit or rescheduling of your trip will depend on the terms and the conditions of the Supplier.    

    

If your booking is affected by a force majeure event and you are entitled to a refund or credit from the Supplier, we will facilitate this refund or credit.

The service booking and consultation fee, credit card fees or any fees received are non-refundable in the event of a force majeure event.

 

 

Hotel/accommodation reservations

    

Some suppliers will require an additional fee to be paid locally (e.g. a tourist tax) at check-in or check-out. This amount is in addition to the amount indicated during the booking process under the "total booking cost" amount.

 

 

There may be taxes collected overseas but not paid at the time of purchase that are due in connection with your hotel reservation (e.g. local taxes, sales taxes, etc.). Any local taxes will be payable by you directly to the Supplier at check in/check out.

 

 

Reservations

 

"Tasukete Pty Ltd" provides recommendations for restaurants, bars and other venues offering menus in English as part of our personalized customer service. However, it is important to note that while we endeavor to ensure that the venues we recommend meet the needs of overseas customers, "Tasukete Pty Ltd" does not accept responsibility for any changes in the availability of English menus at these venues. Ultimately, it is the customer's responsibility to verify that the chosen venue offers an English menu.

Our price estimates for restaurants, bars, museums and other attractions are based on our personal experience and serve as a general reference. We cannot guarantee the accuracy or take responsibility for any price changes by the restaurant, bar, museum, etc. Customers are advised to check current prices directly with the Supplier before making any commitments.    

    

Please note that if a restaurant, bar, museum, etc. contacts us due to a no-show, or if you decide to cancel or change your reservation without providing sufficient notice to avoid cancellation or reservation penalties, we reserve the right to charge a penalty as specified in the “Professional Services Fee Schedule”.

Price and itinerary changes

 

We reserve the right to cancel your booking if we have reasonable grounds to believe it is fraudulent.

​

If a Supplier changes any part of your booking for reasons beyond their control, we will make every effort to inform you. If such changes cause the Product to cost more or make a material difference, you may cancel the Product. Any refund will be subject to the Supplier's terms and conditions.

 

These terms and conditions are subject to change at any time. Any variation will be displayed here and you will be deemed to have accepted a variation if you have made a booking after it has been displayed.

Newsletter and email

​

By subscribing to our website, you acknowledge and agree to receive advertising material from "Tasukete Pty Ltd." If, at any time, you no longer wish to receive emails from us, please contact us via email at info@tasukete.org to unsubscribe. We respect your preferences and will promptly remove you from our mailing list.

Artificial intelligence

​

"Tasukete Pty Ltd" uses artificial intelligence (AI) technology to improve personalized customer service. Our custom chatbot is trained using our proprietary data and is regularly updated to improve the quality and accuracy of responses. However, due to the evolving nature of AI technology, we cannot guarantee absolute accuracy. Customers are advised to double-check the suggestions provided by the chatbot to ensure satisfactory responses.    

    

While our chatbot strives to provide accurate and helpful responses based on our proprietary data, we advise customers to independently verify the suggestions provided.

 

Please note that our chatbot is developed using the services of “OpenAI Global, LLC”. To ensure optimal performance and correct usage, each chat session is limited to a maximum of 40 inputs every 3 hours. If a customer reaches their input limit within this time frame, they will have to wait for the next 3-hour cycle to begin before starting another chat session.

“Tasukete Pty Ltd” is not responsible if “OpenAI Global, LLC” interrupts its service for maintenance or blackout without notice, making our services unavailable. If “OpenAI Global, LLC” notifies you of any service interruptions, we will notify you at the email address you provided.    

    

"Tasukete Pty Ltd" is committed to the development and continuous improvement of our AI technology to provide a better user experience. We value customer feedback and use it to refine the capabilities and functionality of our chatbot.

Your obligations and warranties

 

You guarantee us that:

​

you are at least 18 years of age and have the power, capacity and authority to form a binding contract with us and the Suppliers of the Travel Products you purchase;

​

you have read and understood these terms and conditions and, in the case of booking on behalf of third parties, you have passed these terms and conditions to them

 

the information you provide to us about yourself is true, accurate, current and complete (other than any optional items) as required by any registration process;    

    

you have considered purchasing comprehensive travel insurance and we are not responsible for any failure by you to obtain adequate insurance cover; AND

​

you will use the Booking and Advice Services in accordance with these terms and conditions and you will not use the Booking and Advice Services in any way to violate any law or defame anyone.

Jurisdiction and law

 

All matters arising out of or in connection with the Booking and Advisory Services and these terms and conditions are governed by the laws of VIC, Australia. By purchasing booking and consultancy services, you consent and submit to the exclusive jurisdiction of the laws of VIC, Australia.    

 

 

Definitions

 

“We” and “us” mean “Tasukete Pty Ltd”.

“You” or “your” means any user of our website or any person who acquires the booking and consultancy services, including any person who purchases a travel product (regardless of whether the booking and consultancy services are acquired or less from another person).

“Booking and Consultancy Services” means the services provided by us to you to assist you in purchasing a Travel Product from a Supplier and includes consultancy and consultancy services.

"Force Majeure" means, by way of example: acts of God, accidents, riots, wars, terrorist acts, epidemics, pandemics, quarantines, infectious disease epidemics or any other public health crisis, civil unrest, failure of communication, natural causes, catastrophes, adverse weather conditions, governmental acts or omissions, changes in laws or regulations, national strikes, fires, explosions and general lack of availability of raw materials or energy.

“Travel Supplier” or “Supplier” or “Suppliers” means the company or person who supplies the Travel Product to you under the terms and conditions agreed with you.

“Travel Product” means the service or product provided by a Supplier, such as an airline or hotel.

Professional Services Fee Schedule

​

All service fees are non-refundable

Service Fees

​

35 euros for the 7 days plan, 65 euros for the 14 days plan and 95 euros for the 21 days plan.

​

​

Reservation deposit

​

Some reservations require a deposit of up to 20% to be paid at the time of booking. We will let you know the surcharge before final payment for your booking. This deposit is non-refundable and is in addition to the deposit required by the Travel Supplier. The balance of the booking fee is due as required by the Travel Supplier

​

Modification Fees

 

Changes to bookings may incur a fee of A$20.00 per person per booking in addition to Supplier and credit card fees.

 

​

Cancellation fees

​

Booking cancellations may incur a fee of up to 20% of the booking value in addition to Supplier and credit card fees.

 

​

Credit Card Fees

​

An additional fee applies depending on your card provider (Visa, Mastercard, American Express etc.). Consult your card provider to find out the exact amount.

Privacy Policy

 

“Tasukete Pty Ltd” and its associated entities collect your personal information to enable us to respond to your queries and provide you with booking and consultancy services, including assistance in arrangements with Suppliers (such as hotel and other reservations).

We will also use your personal information to personalize the service we provide to you, including your experience on our and other websites, and to provide you with information about our business, the products and services of our partners. Your personal information may be disclosed to vendors, providers, our cloud infrastructure, our contractors and also to others where authorized or required by law. Some of these entities may be located overseas, including in the countries identified in our privacy policy.

By subscribing to our newsletter, alerts, offers or updates, you confirm that you have read and understand our privacy policy for this service and consent to “Tasukete Pty Ltd” sending you marketing materials, including via electronic messages relating to our products and services and those of our partners this may interest you.

 

 

ANNEX – TRAVEL TIPS FOR TRAVEL PRODUCTS

 

The suggestions below are NOT legally binding terms and conditions.

Passports, visas and health requirements

It is your responsibility to ensure that you have the required documents, including visas and passports, before traveling to your destination. We encourage you to check with the respective Embassy or Consulate of each country you will be traveling to, as many destinations require visas for both Italian and non-Italian passport holders. You must ensure that you have at least 6 months validity on your passport from the date of departure and return.

It is your responsibility to ensure that you are aware of any health requirements for your travel destinations. Vaccinations are strongly recommended for some destinations. You should contact your local doctor who will inform you of these requirements. Please note that vaccinations may be recommended prior to your travel departure date.
